Terms of Service
Last updated: July 10, 2026
1. Agreement and eligibility
These Terms of Service ("Terms") govern your access to and use of app-in.io ("AppIn", the "Service"), operated by ISAP OÜ, Narva mnt 5, 10117 Tallinn, Kesklinna linnaosa, Harju maakond, Estonia, registry code 16838751 ("we", "us"). By creating an account, connecting a site with an API key, or otherwise using the Service, you agree to these Terms. If you act on behalf of a company, you represent that you have authority to bind it.
These Terms are the master agreement for all AppIn products. Specific products may have their own product schedules — for example, the AppIn Search WooCommerce EULA — which incorporate these Terms and prevail over them on product-specific matters. Our Data Processing Agreement is incorporated by reference and prevails on data-protection matters (see section 11).
You must be of legal age in your jurisdiction and legally able to enter into these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of Service and beta status
AppIn provides AI-powered semantic search and chat: a public API (api.app-in.io), a customer dashboard (my.app-in.io), embeddable search and chat widgets served from cdn.app-in.io, optional messaging-channel integrations for the chat assistant (Telegram, WhatsApp, Facebook Messenger), and public documentation (docs.app-in.io). You index your content (a "Site" is one distinct website or store, identified by its domain and API keys) and the Service returns natural-language search results and AI chat responses.
Public beta. The Service is currently offered as a public beta. It is intended to be safe to run on live sites, but during the beta:
- The Service is provided "as is" and "as available" (see section 12)
- There is no service-level agreement (SLA) or uptime guarantee
- Features, quotas, and pricing may change with notice (see section 17)
Support. We aim to respond to support requests within 8 business hours, Monday–Friday 09:00–18:00 CET, via [email protected] (for the WooCommerce plugin, also via GitHub Issues). This is a service target we work to, not a contractual SLA.
We may perform maintenance with reasonable notice; emergency maintenance may occur without prior notice.
3. Accounts and API key security
- You must provide accurate registration information and keep it current
- You are responsible for all activity under your account and for keeping secret API keys (
sk_live_...) confidential — treat them like passwords. Public keys (pk_live_...) identify a Site to the browser widget and are safe to expose client-side - Notify us promptly at [email protected] if you suspect a key is compromised; we may rotate or revoke keys to protect the Service
- One person or entity may not maintain multiple accounts to obtain extra free usage
4. Acceptable use and anti-abuse
You agree not to:
- Exceed, circumvent, or attempt to circumvent quotas, rate limits, or the free trial — including re-registration or multi-account schemes to obtain additional free trials (one trial per account)
- Index or process content that is unlawful, infringing, malicious, or that you lack the rights to submit
- Submit end-user personal data to the Service beyond what our integrations are designed to transmit (see section 11)
- Reverse engineer, probe, or attempt to disrupt the Service, or access it other than through the documented API, widgets, or plugins
- Resell, sublicense, or provide the Service to third parties except as expressly permitted
- Use the Service to build a competing product by systematic extraction of the Service's outputs
- Use the Service in violation of export-control or economic-sanctions laws. You represent that you are not located in an embargoed jurisdiction and are not on any EU, UN, or US restricted-party list
We may throttle, suspend, or terminate access (in whole or part) if we reasonably believe your use violates this section, threatens the security, integrity, or performance of the Service, or harms other customers. Where practicable, we will give notice and an opportunity to cure.
These restrictions apply to the hosted Service only — they do not restrict any rights you have in open-source plugin code under the GPL (see section 10).
5. Free trial
- While our founding programme is open, your first Site may use the full Pro feature set free for two (2) months — no credit card required, no automatic charge at trial end
- We may close the founding programme to new sign-ups with notice. This affects new registrations only — a trial already under way runs its full term. Once the programme is closed, new Sites start on the Free plan instead
- If you have not started a paid subscription by the end of the trial, that Site moves to the Free plan — search and indexing keep working, on the Free plan's lower monthly request allowance
- We do not delete your indexed content or configuration when a trial ends; it is retained while your account and Site are active (see the Privacy Policy for deletion on request or account closure)
- You can also claim the founding trial by connecting the AppIn plugin to a store you registered, within three (3) business days of creating your account
- The free trial is available once per account (see section 4)
6. Plans and pricing
- Pro — €49 / $49 / CHF 49 per month, covering up to 3 Sites per subscription
- 4+ Sites — Enterprise plan with custom terms and pricing; contact us
- Currency — customers in Switzerland and Liechtenstein are billed in Swiss francs (CHF); other customers in the EU and EEA in euros (€); all other customers in US dollars ($)
7. Billing and taxes
- Paid subscriptions are billed monthly in advance via Revolut. You enter your card on our billing page; we never see or store your card details. Each paid invoice is emailed to you and is available to download from your account.
- If a charge fails, we notify you and Revolut retries the charge over the following days. We do not suspend the Service while retries are running. If payment is ultimately not resolved, the subscription ends and the affected Sites move to the Free plan
- You may cancel at any time, effective at the end of the current billing period. No refunds are provided for partial months, except where required by law or as provided in section 18 (service discontinuation)
- EU consumers — if you are a consumer in the EU, you have a 14-day right of withdrawal. By starting a paid subscription you expressly request immediate performance; you acknowledge that you lose the right of withdrawal once the service has been fully performed, and that if you withdraw before full performance, you will pay a proportionate amount for the service already provided
- VAT — ISAP OÜ is not VAT-registered (turnover is below the Estonian €40,000/year registration threshold), so prices do not include VAT and no VAT is charged. If VAT registration later becomes required, VAT may be added to fees on prior notice. You are responsible for any other applicable taxes, except taxes on our net income
8. Fair-use quotas and no silent overage
The Pro plan includes, per subscription:
- 100,000 API requests per month
- 50,000 indexed records
- 10,000,000 AppIn LLM tokens per month
- 180 requests per minute (rate limit)
No silent overage. We do not apply surprise overage charges. If your usage approaches or exceeds these quotas, we will aim to contact you to discuss an Enterprise plan. To protect the platform and other customers, we may throttle or rate-limit usage that materially exceeds the quotas — including immediate automatic throttling of abnormal usage spikes detected by our monitoring — and will notify you promptly afterward.
9. BYOK (Bring Your Own Key)
You may configure your own LLM provider API key ("BYOK") — supported providers: OpenAI, Azure OpenAI, Anthropic, Google Gemini, Mistral. When BYOK is active:
- LLM usage is not counted against AppIn LLM token quotas and is uncapped by AppIn
- Usage is billed to you directly by your provider under that provider's terms and pricing; you are solely responsible for your provider account, its costs, and compliance with its terms
- Your BYOK provider is engaged by you, not a sub-processor of AppIn
- We store BYOK keys encrypted and use them only to provide the Service to your Sites. If a key becomes invalid, revoked, or rate-limited, affected AI features may degrade or stop
10. Customer content and intellectual property
Your content stays yours. You retain all rights in the content you submit for indexing ("Customer Content"). You grant us a non-exclusive, worldwide license to host, process, index, transmit, and display Customer Content solely to provide the Service, subject to section 11 and the DPA. You are responsible for ensuring you have the rights to index the content you submit; we do not review content for legality or accuracy.
Our IP. As between the parties, we own and retain all rights in the Service (the hosted platform, API, models, infrastructure, dashboard, and server-side code) and in the AppIn name, logos, and trademarks. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription, solely for your own Sites.
Open-source plugins. The AppIn Search WooCommerce plugin is open source under GPLv2 or later. Nothing in these Terms restricts your rights in the plugin code under the GPL — the GPL, not these Terms, governs use, modification, and redistribution of the plugin code. These Terms govern only your use of the cloud Service the plugin connects to.
Feedback. If you send us suggestions or feedback, we may use them without restriction or obligation to you.
11. Privacy and data protection
Our processing of account and website-visitor data is described in our Privacy Policy. For Customer Content containing personal data, you are the data controller and ISAP OÜ is the data processor under our Data Processing Agreement (DPA), which is incorporated into these Terms by reference and prevails over them on data-protection matters.
Our integrations are designed so that no end-user personal data is sent to AppIn beyond search query text, chat messages, and standard HTTP request metadata (IP address, user agent, referrer). You must not submit other personal data through Customer Content, and you are responsible for updating your own site's privacy notice to disclose your use of AppIn.
You may request export or deletion of your Customer Content at any time via [email protected]. See also our GDPR overview.
12. Warranties and disclaimers
Each party warrants it has authority to enter into these Terms. Except as expressly stated, and especially during the beta, the Service is provided "as is" and "as available", without warranties of any kind, express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, accuracy of AI-generated output, and non-infringement. We do not warrant uninterrupted or error-free operation, or that search results or AI responses will be accurate or complete.
Some jurisdictions do not allow the exclusion of certain warranties; statutory rights that cannot be excluded — including mandatory EU and Estonian consumer rights — remain unaffected.
13. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill
- Our total aggregate liability arising out of or relating to these Terms or the Service is limited to the fees you paid us in the 12 months preceding the claim
- We are not responsible for data loss due to your failure to maintain your own backups of source content
Nothing in these Terms limits liability that cannot be limited by law — including fraud, willful misconduct, death or personal injury caused by negligence, or non-excludable consumer rights.
14. Indemnification
You will defend, indemnify, and hold harmless ISAP OÜ and its affiliates from and against third-party claims, and the resulting damages, costs, and reasonable legal fees, arising from: (a) Customer Content — including claims that content you submitted for indexing infringes third-party rights; (b) your use of the Service in violation of these Terms or applicable law; or (c) your violation of your own end users' rights.
We will give you prompt notice of any such claim and reasonable cooperation, and you may control the defense and settlement, provided any settlement fully releases us and does not require us to admit fault. Your obligations under this section are not subject to the liability cap in section 13. To the extent you are a consumer under mandatory EU or Estonian law, this indemnity applies only to the extent permitted by that law.
15. Term, cancellation, and no lock-in
These Terms apply from your first use of the Service and continue while you have an account or active subscription. No lock-in: you may cancel at any time, effective at the end of the current billing period — there are no long-term commitments.
On cancellation or termination, your right to the paid Service ends and the affected Sites move to the Free plan (and are deactivated on account closure). Where an account has more Sites than the Free plan allows, the newest Sites over that limit are parked — their content is retained but not served — until the account upgrades again. You may export or request deletion of your Customer Content (section 11); otherwise it is retained while your account is active, and on account closure removed within the window described in the DPA unless the DPA or law requires otherwise. We may suspend or terminate for material breach (including non-payment or abuse under section 4) with notice and, where practicable, an opportunity to cure.
16. Referral program
If you refer another store and the referred customer converts to a paid subscription after their trial, you receive one (1) additional free month of the Service, credited to your subscription. The credit accrues on conversion, not on sign-up. Agency commission or revenue-share arrangements are governed by a separate written agreement, not these Terms. We may modify or discontinue the referral program with notice; referral rewards may not be exchanged for cash except where required by law.
17. Changes to these terms
We may update these Terms, quotas, or pricing. For material changes we will give prior notice by a reasonable means (email or dashboard notice) before the change takes effect. Changes do not apply retroactively to a billing period you have already paid for. Your continued use after a change takes effect constitutes acceptance; if you do not agree, you may cancel under section 15.
18. Service modifications and discontinuation
We may add, change, or remove features and update the technology, models, and infrastructure underlying the Service, provided we do not materially degrade the core functionality of a paid subscription during a billing period you have already paid for.
We may discontinue the Service, or a material part of it, on prior notice by a reasonable means. If we discontinue a paid service for reasons other than your breach, we will, where practicable, let you export your Customer Content before access ends and will refund any prepaid, unused fees on a pro-rata basis.
19. General provisions
- Force majeure — neither party is liable for failure or delay (other than payment obligations) caused by events beyond its reasonable control, including natural disasters, war, civil unrest, failures of third-party hosting, network, LLM, or infrastructure providers, denial-of-service attacks, or changes in law. This clause does not limit our liability for sub-processors' data-protection obligations under the DPA, or any liability that cannot be excluded by law
- Assignment — you may not assign these Terms without our prior written consent, except to a successor in a merger, acquisition, or sale of substantially all assets, on notice to us. We may assign these Terms to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets. Prohibited assignments are void
- Sub-processors and third-party services — the Service relies on third-party providers (hosting, CDN, payments, LLM providers). We remain responsible for their performance in providing the Service. The current list of personal-data sub-processors is maintained in the DPA. Any BYOK provider you configure is engaged by you, not by us
- Independent parties — the parties are independent contractors; these Terms create no partnership, joint venture, agency, or employment relationship
- No third-party beneficiaries — these Terms confer no rights on any third party, except that our disclaimers and limitations of liability (sections 12–13) extend to our affiliates and sub-processors
- Notices — we may give notice by email to your account address, by dashboard notice, or by posting to app-in.io. You may give notice to us at [email protected]. Notices are deemed given when sent or posted
- Entire agreement — these Terms, together with the DPA, the Privacy Policy, any applicable product schedule, and any plan or order details expressly incorporated, are the entire agreement regarding the Service and supersede prior agreements on that subject. The GPL governs open-source plugin code and is unaffected by this clause
- Severability — if any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remainder stays in effect
- Waiver — failure to enforce a provision is not a waiver of the right to enforce it later; waivers must be in writing
- Survival — provisions that by their nature should survive termination (accrued fees, sections 10–14, 19–20) survive
- Order of precedence — in case of conflict: (a) the DPA governs data-protection matters; (b) the GPL governs plugin code; (c) the applicable product schedule governs product specifics; (d) otherwise these Terms govern
20. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-laws rules. The courts of Estonia have exclusive jurisdiction, with the court of first instance being Harju County Court (Harju Maakohus), Tallinn — subject to mandatory EU or Estonian consumer-protection rules that allow a consumer to bring proceedings in their place of residence.
